Introduction

These Terms and Conditions govern your use of services provided by AP DEVOTION ENTERPRISE (Registration No: 202503329785). By engaging our services, you agree to these terms.

Definitions

  • "Services" refers to web development, design, digital marketing, and related digital services provided by AP DEVOTION ENTERPRISE.
  • "Client" refers to any individual or entity that engages our services.
  • "Deliverables" refers to any materials, products, or outcomes produced as a result of our services.
  • "Project" refers to the scope of work agreed upon between the Client and Service Provider.

Services

We provide web development, design, and related digital services. All services are provided on an "as is" basis.

Any services not explicitly included in the project proposal are considered outside the scope of the agreement and may require additional fees.

Project Timeline and Deliverables

We make every effort to complete projects within the estimated timeline, but timelines are estimates and not guarantees.

  • Client delays in providing necessary information, feedback, or approvals
  • Changes to the project scope
  • Technical challenges unforeseen at the project outset
  • Force majeure events

Payment Terms

Late payments may result in work being paused until payment is received. Late payment fees may apply.

  • An initial deposit (non-refundable) to commence work
  • Milestone payments based on project progress
  • Final payment upon project completion

Client Responsibilities

  • Provide accurate and complete information necessary for project completion
  • Review and provide feedback on work in a timely manner
  • Make payments according to the agreed schedule
  • Obtain necessary permissions, licenses, or consents for any content provided to us
  • Designate a primary contact person for communication regarding the project
  • Attend scheduled meetings or calls related to the project
  • Notify us promptly of any concerns or issues related to the project

Intellectual Property

Upon full payment of all invoices, the Client receives rights to final deliverables as defined in the project agreement.

  • Custom code developed specifically for the Client becomes the Client's property
  • The Client receives a license to use third-party elements incorporated in the deliverables
  • We retain rights to concepts and designs not selected for the final project
  • We retain the right to use completed work in our portfolio for self-promotion
  • Any pre-existing intellectual property owned by us remains our property

Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from the use of our services.

Our total liability shall not exceed the total amount paid for the services.

Confidentiality

Both parties agree to maintain the confidentiality of proprietary or sensitive information shared during the project.

Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms shall be resolved in the courts of Malaysia.

Amendments

We reserve the right to update or modify these Terms and Conditions at any time without prior notice.
